Sex! Gossip! Scandal! For more than 60 years, the National Enquirer has pumped out salacious, shocking stories, stretching the limits of journalism and blurring the lines between truth and fiction. The sensational true story of the most infamous tabloid in U.S. history, a wild, probing look at how one newspaper’s prescient grasp of its readers’ darkest curiosities led it to massive profits and influence. From its coverage of Elvis’s death to the O.J. Simpson murder trial, the National Enquirer rattled the foundations of American culture and politics, sometimes allegedly using payoffs, and blackmail to get its scoops.

Esse Studios Wins Australia’s National Designer Award

SYDNEY — Sydney fashion label Esse Studios took home the 24th National Designer Award at the Virgin Australia Melbourne Fashion Festival.
Announced on Wednesday at the Melbourne flagship of David Jones on the first day of the festival, which runs until March 14, Esse Studios designer Charlotte Hicks will receive a prize package valued at 120,000 Australian dollars or $ 78,823 at current exchange. This includes 10,000 Australian dollars or $ 6,569 cash, business advisory services and the opportunity to develop a capsule collection with award partner David Jones.
A graduate of the University of Technology Sydney, Hicks launched her label in 2017 after spending five and a half years as a designer for Sass & Bide and previous roles at companies including Zimmermann. With a focus on denim, cotton and knitwear, Esse Studios specializes in “slow release” editions of small capsule collections.
The judging panel included Vogue and GQ Australia creative director Jillian Davison and Bridget Veals, Eloise Bishop and Chris Wilson, David Jones’ heads, respectively, of women’s wear and accessories, sustainability and men’s wear.

Jay-Z & Beyoncé Sit Down During Super Bowl National Anthem

Pre-GRAMMY Gala and GRAMMY Salute to Industry Icons Honoring Sean "Diddy" Combs - Inside

Source: Kevin Mazur / Getty

Today (Feb. 2), Jay-Z and Beyoncé stayed seated while Demi Lovato sang the national anthem at the Super Bowl. The couple, and their eldest daughter, where spotted by cameras but no word if it was a proper protest, yet.

According to TMZ, the Carter family was sitting together a few rows back from the field, and were clearly unbothered about standing during the singing of the national anthem, as everyone around them was on their feet.

The timing of the move raises plenty of eyebrows since Jay-Z is literally in league with the NFL since Roc Nation is a partner as announced last year. Jay-Z’s brand has been tasked with curating the NFL’s musical endeavors and leading its social justice platform/programs. A big New York Times feature story yesterday (Feb. 1) details how Roc Nation is involved while Jay-Z continued to defend the partnership that received criticism in lieu of Colin Kaepernick’s blackballing by the NBA.

“No one is saying he hasn’t been done wrong. He was done wrong,” said Jay-Z when asked about Kapernick by the New York Times.  I would understand if it was three months ago. But it was three years ago and someone needs to say, ‘What do we do now — because people are still dying?’”

New England Patriots owner Robert Kraft is who brought Jay-Z and the NFL together. So how this plays out is going to be very interesting.

Also, before you even go there, Blue Ivy is in the no slander zone—she’s a child.

This story is developing.

Director of the Dutch national Ballet and award-winning choreographer Ted Brandsen has taken the turbulent life of the Dutch dancer and spy Mata Hari as his inspiration for a lavish new full-length ballet. A new score has been specially commissioned from GRAMMY nominated composer Tarik O‘Regan. Margaretha Zelle is one of the most infamous and iconic women in Dutch history. Desperate to escape the boundaries of reality, Margaretha reinvented herself as the exotic, Javanese princess Mata Hari. It is a tale that is as relevant today as it was 100 years ago: an ambitious young woman does whatever it takes to find the fame and fortune she craves. But Mata Hari was playing a dangerous game, and ultimately she would pay with her life.

Method Man & Redman, Young M.A To Headline DC’s 5th Annual National Cannabis Festival

Summertime In The LBC

Source: Scott Dudelson / Getty

For the fifth year in a row, the Nation’s Capital will be covered in a familiar and peace-loving haze this coming April. The National Cannabis Festival makes its return to the RFK Stadium Festival Grounds, with Method Man, Redman, and Young M.A are set to headline the event.

Joining Tical, Funk Doc, M.A and Antibalas on the stage will be local favorites, Go-Go legends Backyard Band, reggae band The Archives, Lee, Blackwood and Graham, and DJ Farrah Flosscett.

The festival will go down on Saturday, April 18, just before the national toker’s holiday of 420. Ahead of the festival, the annual National Cannabis Policy Summit takes place on April 9 at the Ronald Reagan Building in Washington,  where leaders in the movement discuss a number of policy issues, initiatives and other topics of note within the budding industry. Also worth stating that the summit is free to the public but space will be limited.

The festival, already a sprawling and amazingly vast affair, will also feature the Veterans Lounge, a low-key section of the event where former military personnel and their families can join in on the festivities. Last year, NCF handed out over 200 tickets to veterans with some coming from all over the east coast to attend, share ideas, and bring renewed energy to cannabis efforts in their respective places of residence.

There will also be a senior citizen’s lounge for seasoned cannabis advocates. The NCF is also bringing back its Ultimate Weed Wedding, a contest where a lucky couple will take the stage and exchange vows with thousands of onlookers who share their passion for cannabis.

Melania Trump Hits Snake River During ‘Be Best’ Trip to Promote National Parks Service

HEAD FOR THE HILLS: While the impeachment inquiry into President Trump heats up inside the Beltway, First Lady Melania Trump winged it out West to visit two National Parks and to promote her “Be Best” initiative.
After landing at the Jackson Hole Airport, FLOTUS arrived in the town square to find several hundred people lined along the sidewalks, including some singing “The Star Spangled Banner,” according to a pool report. Shortly before noon, the First Lady greeted local Boy Scouts, spending 30 seconds to a minute with each. Her latest goodwill mission is meant to draw attention to the wellness pillar of her child-friendly “Be Best” program. Last week she took that message to a more adult audience by ringing the starting bell at the New York Stock Exchange with the help of fourth graders from the United Nations International School.
The First Lady’s 48-hour tour of Teton Country will include stops at two of the 380-plus units in the National Parks Service — Grand Teton and Yellowstone. While the Sept. 23 appearance on Wall Street called for business attire — a black cap-sleeved Prada dress — her journey into the great outdoors started with more relaxed looks. Trump touched down in

Free People Supports National Park Foundation With Yearlong Partnership

ROOM TO BREATHE: With getting outdoors being top-of-mind for many as summer approaches, Free People has finalized a yearlong partnership with the National Park Foundation to help draw attention to the national parks.
As part of the deal, the Philadelphia-based company has donated $ 100,000 to the foundation and will be encouraging consumers to get out in the open air through monthly community events. A launch celebration was held at the Joshua Tree National Park highlighted with wellness events, a guided hike and farm-to-table meals. In addition, Free People plans to donate 25 cents from every transaction to the NPF, when a customer opts to not have a shopping bag or uses a reusable one in stores. Brands are increasingly championing wellness and sustainability to appeal to environmentally minded shoppers.
Chartered by Congress in 1967, the NPF raises private funds to help protect more than 84 million acres of national parks through critical conservation and preservation efforts among other things. Ludacris, Action Bronson Headline 4th Annual National Cannabis Festival In D.C.

National Cannabis Festival Washington DC

Source: National Cannabis Festival / National Cannabis Festival

The Nation’s Capital will undoubtedly be draped in a curious haze of smoke this coming Saturday (April 20), most especially the grounds of RFK Stadium. The fourth annual National Cannabis Festival kicks off at noon on 420, with Ludacris and Action Bronson sharing the top billing.

Along with Luda and Bronsolini, Washington’s legendary Go-Go band, The Junkyard Band, will also take the NCF stages. Joining the aforementioned acts are reggae band Strykers Posse, brass band Black Masala, and DJ Farrah Flosscett.

While music and, ahem, the sticky green leaf will be the center of the festivities tomorrow, NCF organizers also held a National Cannabis Policy Summit earlier today (April 19) at Washington’s Newseum, and we’ve breezed through to find a well-attended event with some of the most knowledgeable marijuana advocates and activists in the region and beyond.

In case you’re up for joining tomorrow’s party, check out more information about the National Cannabis Festival here.

Ole Miss Basketball Players Kneel During National Anthem To Protest Local Pro-Confederate Rallies

Mississippi v Georgia

Source: Logan Riely / Getty

The Ole Miss basketball team is woke (well, some of them). Players on the squad knelt during the national anthem in protest of pro-Confederate rallies happening near their university’s campus.

Deadspin reports that K.J. Buffen, Terence Davis, Luis Rodriguez, Bruce Stevens, Devontae Shuler and Breein Tyree took a knee before the team’s home game against Georgia on Saturday (Feb. 24). A total of eight players kneeled per reports.

Reports ESPN:

Minutes before the game, both teams formed lines for the anthem. As “The Star-Spangled Banner” began, six Rebels players — who appeared to be KJ Buffen, D.C. Davis, Brian Halums, Luis Rodriguez, Devontae Shuler and Bruce Stevens — knelt one by one. Two more players — appearing to be Breein Tyree and Franco Miller Jr. — took a knee on the song’s final line.

The game was being played while two pro-Confederacy groups organized a march onto the campus in Oxford, Mississippi.

“The majority of it was we saw one of our teammates doing it and we just didn’t want him to be alone,” Ole Miss scoring leader Tyree said after his team’s 72-71 victory. “We’re just tired of these hate groups coming to our school and portraying our campus like it’s our actual university having these hate groups in our school.”

So no, they weren’t disrespecting the flag or servicemen. Star player Tyree later tweeted: “To the people that fight for this country, my teammates and I meant no disrespect to everything that you do for us, but we had to take a stand to the negative things that went on today on our campus. #WeNeedChange”

The team’s coach, Kermit Davis, was unaware the protest was going to happen, but he supported his players, as he should.

Respect.

National Jewelry Institute Partners With Parsons

The National Jewelry Institute is going back to school.
Following its gala dinner at the Louvre in July, the institute will kick off its next banner initiative on Monday: a week of jewelry-centric courses held at The New School’s Parsons School of Design. News in Brief: National Weather Service: ‘Don’t Go Surfing Unless You Can Really Shred That Shit’

SILVER SPRING, MD—Warning that Hurricane Joaquin was expected to produce powerful winds, violent swells, and dangerous rip currents, the National Weather Service strongly advised Americans today not to go surfing unless they could really shred that shit. “As Joaquin gains strength and begins to approach the Eastern Seaboard, we would like to remind the public that they should not attempt to enter the surf if they are unprepared to carve up these bitchin’ tubes,” said NWS director Louis Uccellini, sternly warning that those not aggro enough to charge these gnar gnar waves are going to be getting seriously cranked all day. “All of our predictive models and real-time data suggest that the waves produced by this system will be beyond mondo, and we cannot stress enough that you should remain out of the water if you’re a weak little kook or chrubee. How One 14-Year-Old’s Dream To Help Underprivileged Girls Became A National Success

Most 14-year-olds are busy studying for biology tests, trying out for school sports teams and musical productions, and searching for spare time to sleep. Not Allyson Ahlstrom.

At age 14, she started a non-profit organization, and nearly six years later, Threads for Teens is a nationally-recognized organization doing incredible work. The organization’s mission statement explains that it aims to inspire confidence in young women by providing underprivileged teen girls with the opportunity to pick out a new outfit or two from the back of the company’s mobile boutique, which is run out of the back of a pink 18-wheeler.

The Threads for Teens on Tour truck!!! #cantwaittostart #threadsforteens

A photo posted by threadsforteens (@threadsforteens) on

Threads for Teens is based out of Santa Rosa, California, where they have one stationary store. Their clothing racks, and those on the touring truck, are stocked with clothing and accessories which have been donated by a number of local stores as well as nationwide chains including Santa Rosa’s Punch Clothing, LF Stores, Claire’s, and their latest partner, Rue 21.

Ahlstrom has been recognized by dozens of local and national news stations, and featured on TV shows including the Queen Latifah Show and the TODAY show.

And it doesn’t look like Ahlstrom will be stopping anytime soon. This fall, Ahlstrom is taking her organization and its trusty mobile store on tour around the country to deliver clothing to young women all over the nation.

Ahlstrom told the Huffington Post that her initial inspiration for the organization came from reading a book about other young entrepreneurs called Generation Change.”The book was about different service projects teenagers across the country led, some even as young as 12! It was at that point that I decided to do something myself. I came up with the idea for a one-time clothing drive, that has since grown into a national non-profit organization.”

Asked about her mentality throughout the process, Ahlstrom said “I never thought about not being able to succeed, I mostly thought about how I could accomplish the clothing drive. When starting a project, I think it’s important to have big dreams, but to also be realistic about what will happen to begin with. For me, giving ten girls a new outfit was what I wanted to accomplish. I did not start out thinking about going on a national tour.”

As for her advice to young people who are interested in making a real difference in their communities, Ahlstrom says, “Absolutely do not doubt anything!” She says she was surprised by how eager people were to serve their community and pitch in. She also reminds us that no act is too small to count, saying “volunteering for an hour a week (4 hours a month), can have a profound impact on an organization. Making an impact does not have to be on a gigantic scale.”

Ahlstrom says she wants to “grow Threads for Teens into a global girl empowerment organization.” She says she hopes to “open boutiques in all fifty states and around the world,” and even “develop girl empowerment curriculum, build a scholarship endowment, and host a girls summit.”

Check out the Threads for Teens Facebook page and Twitter profile to stay up to date on Ahlstrom’s progress.

News in Brief: National Dialogue Dusted Off

WASHINGTON—Following news of a racially motivated shooting massacre in South Carolina that left nine churchgoers dead Wednesday night, the country figured it was once again time to dust off the national dialogue, sources confirmed. “After yesterday’s tragic shooting in Charleston, we felt it was probably time to pull this old thing off the shelf, blow away some of the dust that’s collected on it, and crack it open,” said Mark Fulton, 43, of Reading, PA, referring to the decades-old discourse regarding the kind of free, safe, and respectful society that we as Americans want to live in, which the nation pulls out a dozen or so times a year in the immediate aftermath of unconscionable violence. “Obviously, we won’t be focusing on the parts about police brutality that we’ve used the last few times, but the other sections about racial tolerance, mental health, and gun …

National Security and Privacy Secretly Wed in Las Vegas

Following months of rumors, it’s been revealed that Privacy and National Security were secretly married weeks ago in Las Vegas, Nevada. “We’re tired of all the naysayers constantly describing us as incompatible. We’ll show you. We’ll show you all! Ha!” the couple wrote in a phone text message to friends that was, ironically, extracted by government analysts randomly searching piles of metadata.

The pair exchanged vows at the Holy Chapel of the Inebriates and chose a Western-themed ceremony which featured tumbleweeds, yodelers, but did not include a cash-only minister fee of $ 60. “They made such a lovely couple,” said one of the witnesses who wished to remain anonymous; he was later identified as 58-year-old Byron Hattentoll through information extracted by government analysts randomly searching piles of metadata.

(Breaking news: Eight hours after the wedding, Privacy and National Security filed for divorce, citing Constitutionally irreconcilable differences. Their mutual acquaintance Due Process noted: “Duh.”)

This Is What It Looks Like To Get Rejected On National Television

Getting turned down for a date is humiliating. Getting turned down for a date on national television is the kind of next-level humiliation that haunts you for the rest of your life.

That’s what happened on the latest episode of “The Graham Norton Show,” when a poor, poor man named Thomas asked Jessica, a woman in the audience, out on a date. Apparently, Jessica had already postponed a date with Thomas so she could see Kylie Minogue on Graham’s show.

Little did Jessica know, ol’ Tommy boy was backstage, ready and willing to ask her out again. Little did Thomas know, he was about to get rejected again, only this time on TV. Stone cold.

Watch the clip above to see the cringe-worthy segment in its entirety.

Maya Rudolph Sings Beyonce-Inspired National Anthem At Tulane Graduation

When you invite Maya Rudolph to be your commencement speaker, you can’t expect just a typical speech. Rudolph brought it out at Tulane University’s commencement on Saturday, giving a hysterically inspiring address before doing her own unique interpretation of the National Anthem.

“It really is a true honor to be with all of you as you begin this new phase of your life,” Rudolph told graduates, “as you embark on this exciting and challenging journey of being sober during the day.”

It was the first of many jokes throughout the speech, which included an Oprah imitation (“YOU get a diploma!”) and an extended explanation of her alleged procrastination to write the speech.

Rudolph talked about her telling her father — a Tulane grad — that she wanted to be on Saturday Night Live when she graduated from the University of California, Santa Cruz. She went through improv classes and learned the classic rule: to any situation, say “yes, and.”

“Say yes, and,” Rudolph said as advice to the graduates. “Create your own destiny. Hold onto your old friends. Kiss your mama. Admit what your dreams are. Don’t beat yourself up if you don’t know what you’re gonna do tomorrow, but work hard and don’t be lazy. And put away your damn iPhone once in a while.”

To end her speech, she asked graduates to stand. Taking advantage of her time on a mic in the Mercedes-Benz Superdome in New Orleans, she sang a ridiculous national anthem — with a bit of Beyonce mixed in.

Bill Maher Says 4/20 Should Be A National Holiday On ‘Real Time’

Bill Maher wants stoner holiday 4/20 to be officially recognized.

On HBO’s “Real Time With Bill Maher” Friday night, the host announced that he’d created a Change.org petition calling on Congress to make April 20 a national weed-related holiday. He then showed his panelists how he likes to celebrate the day with a reading of “‘Twas the Night Before 4/20,” a riff on the famous poem “A Visit from St. Nicholas.”

“Twas the night before 4/20 and all through the crib,” read Maher, “not a creature was stirring, not even — did you hear something? Is the door locked?”

“I was wearing a T-shirt and shorts from the gym,” he continued. “I had just settled down to watch Adult Swim.”

Dr. Ben Carson: National Malpractice

By Rory Winston

Upon hearing Ben Carson, the touted archangel of the archconservatives, proclaim that being gay is a choice, a fact illustrated by all those straight men who turn gay in prison, I couldn’t help but envision SNL’s Kenan Thompson getting up as Carson and saying, “Being Ben Carson is a choice, a fact illustrated by all those smart men who turn into creationists shortly after joining the Republican Party.” A retired neurosurgeon, Carson abandoned his area of expertise to pursue a career that isn’t exactly brain surgery.

In an effort to stave off accusations of homophobia, he recently found it necessary to invent a pseudoscientific basis for his distorted perspective. Qualifying his antediluvian worldview with a syllogistic fallacy, he proposed that since straight men often supposedly turn gay while being in prison, one can conclude that being gay is something one chooses, and that it is further correct to infer that all gay men have consciously made a similar choice about their sexuality at one time or another. In the resounding words of big Ben, “[They] go into prison straight, and when they come out, they’re gay. So did something happen while they were in there? Ask yourself that question.”

Personally, I don’t believe it’s necessary to ask myself anything of the sort. In fact, it makes about as much sense to ask Carson’s question as it would to ask if men with muscular physiques have criminal minds just because most men look very buffed up after a period of incarceration. Applying Carson’s winning formula to other areas of human behavior makes for wonderfully colorful and cost-efficient research. To find out whether or not celibacy is a lifestyle choice, one could, for example, simply examine the behavior of a person marooned on a desert island. If the person isn’t happy, then all celibates must be fooling themselves into thinking they are alone by design.

2015-03-05-1425587831-7262627-Ben_Carson_MD.jpg

Although it may come as a shock to Carson, most people are in precisely the type of gender relationship they had been drawn to from early on — born to be wild, mild, straight, gay and often “getting bi with a little help from our friends.” The fact that these dynamics may alter in prison says more about the restrictive setting than about those who are forced to be there. No one disputes that besides genuinely gay prisoners and some who come out, there are also heterosexual prisoners who settle for gay companionship while incarcerated. Similarly, we should recognize that in repressive theocracies it is often the opposite that holds true: Under these circumstances, vast numbers of gay men and women are forced to turn to heterosexual relationships out of fear or simply for the sake of solace. Imposed constraints can alter natural desires. People make do, often settling for less. Whether love wrought under dire circumstances lasts once those constraints are removed is an entirely different matter.

As the reputed Republican Hopeless for the 2016 presidential election, Carson takes every opportunity to congratulate himself on his ability to speak his mind at any cost — the cost in this case being the reinforcement of an utterly nonsensical and dangerous notion, but the cost in all cases being rationality and someone else’s well-being. Although Ben plays the “bad boy” iconoclast card on a regular basis, he is very careful never to step outside party lines. His anti-politically correct posturing is not only overtly political in nature but is about as correct as most opportunism: right for himself and those who finance him.

As a rags-to-riches success story, Carson has been getting away with incendiary comments for quite some time. While many of us may have been taught that kids say the darndest things, we often forget that very accomplished adults are often capable of saying the dumbest things. Having compared Obamacare to 9/11, recent Democratic initiatives to slavery, and the president’s vision to Mein Kampf, the good doctor seems to be on a roll. It’s not hard to imagine just what kind of surgery Carson would recommend for our nation in order to save it from deadly cancers like same-sex marriage and equal opportunity.

In case the day should come when, in our fear, we do sign a consent form empowering someone like Dr. Run-Ben-Run Carson to lobotomize our democracy, well, not to worry, we’ll still have those other geniuses to run to. I think they used to call them rocket scientists.

ASME Announces Finalists For 2015 National Magazine Awards

The American Society of Magazine Editors revealed the nominees for its annual National Magazine Awards during an hour-long Twittercast Thursday.

A total of 66 outlets were nominated across two dozen categories, with publications competing for distinctions in everything from reporting to fiction to design to video. Better Homes and Gardens, Cosmopolitan, The Hollywood Reporter, New York and Vogue, however, are the five publications in the running for the group’s most esteemed award, Magazine of the Year. Bloomberg Businessweek, GQ, The New York Times Magazine, The Atlantic, Politico and The New Republic are also among the magazines to receive multiple nominations.

“The National Magazine Awards 2015 finalists demonstrate the enduring power of magazine journalism in print and on websites and mobile,” Sid Holt, chief executive of ASME, said in a statement. “Whether it’s politics, fashion, sports or the kind of service journalism that only magazines can do, readers know that their favorite print and digital magazines are where to find information and entertainment they can trust.”

A handful of memorable articles are also up for top prizes. Monica Lewinsky’s “Shame and Survival,” for Vanity Fair, and Ta-Nehisi Coates’ long-form cover story “The Case for Reparations,” for The Atlantic, are both finalists for ASME’s Essays and Criticism award, which “honors interpretative and critical journalism.”

Marriage Equality Is a National Issue, And So the Time Has Come for Our National Court to Address It

The Supreme Court has been reluctant to jump into the question of same-sex marriage, preferring to let the issue percolate through state-by-state litigation in the lower federal courts.  But the time has come for the justices to come out of hiding.  The denial of marriage equality is a national problem, not a state-level problem, and it requires a national resolution that only our nation’s constitutional court can provide.

At the moment, 35 states allow marriage equality, while 15 forbid it.  The anti-equality states not only refuse to allow same-sex marriages to be licensed and celebrated; 14 of them also refuse to recognize marriages from sister states where such unions are perfectly legal.  Petitions from cases in four of those states – Kentucky, Michigan, Ohio, and Tennessee – will be considered by the justices at their next private conference this coming Friday.

One reason marriage equality is a national issue is that our current patchwork of marriage laws imposes unreasonable, indeed absurd, burdens on same-sex couples’ security in their marriages and their freedom to move from state to state.  A married gay couple from a pro-equality state can relocate for job, education or family reasons to an anti-equality state – as long as they’re willing to give up their marriage, and perhaps even their property and parental rights.  A rational legal regime cannot tolerate this state of affairs.

In a 2012 article in the Michigan Law Review, I first proposed that the Constitution provides not only a right to get married, but a right to remain married.  Multiple federal court decisions, including one from the 10th Circuit U.S. Court of Appeals involving Utah’s marriage laws, have since endorsed this principle.  There is also an argument to be made that denial of interstate marriage recognition offends the Constitution's Full Faith and Credit Clause.

Aside from the harms they inflict on couples, inconsistent state marriage laws also cost American businesses $ 1.3 billion per year, according to a study released in October by the consulting group Marsh and McLennan Companies.  “As marriage confers a host of legal and social privileges,” the report explains, “the irregular landscape generates a host of administrative and compliance requirements for employers."

A patchwork of marriage laws also means a tax penalty for employers and employees in states without the freedom to marry, because the value of spousal health insurance and other benefits for an employee in a same-sex household is treated as ordinary income, triggering additional payroll and income taxes.  “As many corporate leaders now view national freedom to marry as inevitable,” the Marsh and McLennan report observes, “they would prefer that this tax and compliance burden disappear sooner rather than later."

There is another important reason why marriage equality should be settled at the national level: that is where the campaign to ban it has always been fought.

Although same-sex marriage was not possible in the United States until a decade ago, affirmative and categorical prohibitions are a relatively recent phenomenon.  The first state constitutional amendments banning marriage equality were not passed until 1998, when voters in Alaska and Hawaii approved measures effectively overturning state court rulings favorable to marriage equality.  By 2008, only 10 years later, more than 30 states had approved such measures.

Aside from the harms they impose, I have argued that the process that was used to enact these measures raises serious constitutional concerns.  It is fanciful to believe that these laws were the products of carefully considered, historically validated, independent policy decisions by each state, and thus worthy of deference as a matter of federalism.  For the most part these laws were, in fact, products of a determined, nationwide blitzkrieg by religious conservative activists and Republican operatives.  In the 2004 elections, President George W. Bush’s strategist Karl Rove helped oversee efforts that saw 11 anti-marriage equality measures approved in one swoop.  James Dobson, founder of the once-powerful group Focus on the Family, called the nationwide fight against gay marriage “our D-Day, or Gettysburg or Stalingrad.”

The campaign was one of classic backlash:  it sought to exploit short-term public passions and prejudices to slam the door on marriage equality just as a national debate was starting to emerge on the issue.  As CNN’s report the day after the 2004 elections described it, “Six months after gay and lesbian couples won the right to marry in Massachusetts, opponents of same-sex marriage struck back” with amendments in 11 states “codifying marriage as an exclusively heterosexual institution.”

Experience demonstrates that when Americans learn more about gay people and their relationships, they become more likely to support marriage equality.  Even while marriage equality opponents were still enjoying success at the voting booth, attitudes were evolving: between 1998 and 2009, the average vote against mini-DOMAs in statewide referenda increased from 31 percent to 46 percent.

If the remaining marriage bans took the form of ordinary statutes that could be revisited by legislatures in light of the growing majority support for same-sex marriage, there might be less reason for the Supreme Court to act right now.  But all 15 remaining bans are in the form of state constitutional amendments, which are much harder to undo because they typically require legislative supermajorities, votes in multiple legislative sessions, and/or statewide voter referenda.

This emphasis on constitutional amendments also was a deliberate strategy pursued at the national level by anti-gay-marriage activists.  The goal was not merely to enact laws that appealed to lawmakers and voters at the time, but to place the question of same-sex marriage beyond democratic debate and the ordinary lawmaking process – that is, persuading a simple majority of your elected representatives, the way most laws are made or repealed – in as many states as possible, for as long as possible.  The spirit of these efforts was captured by a Georgia Republican politician who urged his state to adopt a constitutional amendment because it would “set in stone that marriage in this country is a union between one man and one woman.  The laws of man did not create marriage; the laws of man should not alter marriage.”

The campaign against same-sex marriage has seen its fortunes dramatically reversed in the past few years.  Many Americans who once opposed gay marriage have, with better information and greater reflection, changed their minds.  It is an important principle of the Supreme Court's equality jurisprudence that courts should not intervene in such matters too hastily, because “the Constitution presumes that even improvident decisions” by lawmakers or voters can “eventually be rectified by the democratic processes.” But in the 15 states where anti-equality laws remain, they are embedded in state constitutions, and the ordinary democratic lawmaking process cannot address them.

And so the time has come for the Supreme Court to step in.  The campaign against marriage equality was mapped and executed at the national level, and it continues to impose harms and indignities on individuals and businesses that reverberate across state boundaries.  The validity of such laws should be weighed and ruled upon by the justices whose responsibility it is to interpret and apply our highest national law, the Constitution.

Russian Cat Stands for National Anthem Because He's Really, Really Patriotic, Duh

Perhaps this Russian cat feels compelled to stand when the anthem is played because he has an inherent love for his country, and a need to show undying allegiance.

Or maybe he’s just a cat being a cat, doing a weird cat thing, that we humans will never understand.

But let’s just pretend, because it’s Friday, that this cat is standing because he’s really, really, really ridiculously patriotic.
